General Conditions of Sale
These General Terms and Conditions of Sale (GTC) are concluded between, on the one hand ROSHANARA SARL (known as ROSHANARA) - 65 rue Berthier, 78000 Versailles - registered with the RCS of Versailles under number 428894943 and, on the other hand the Internet user, (known as The Customer), who wishes to make a purchase on the roshanara.com website visible at the following address: https://www.roshanara-paris.com
These T&Cs govern the sale of products offered for sale by Roshanara on the Website. The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other condition. The items are only offered for sale to non-commercial individuals. They are concluded intuitu personae and cannot therefore be the subject of any assignment.
The Customer declares:
- to have the capacity to conclude this contract, i.e. to be of legal majority and not to be under guardianship or curatorship.
- not to proceed with purchases of products with a view to reselling them, of whatever nature.
Any order duly validated on the Website implies full and unreserved acceptance of these T&Cs. The GCS may be subject to modifications, the applicable conditions are those in force on the Website on the date of placing the Customer's order and possibly the particular conditions or specific to one or more products or orders.
Item 1. PURPOSE
These GCS aim to define the rights and obligations of the parties as well as the different stages of the ordering process for the products offered for sale on the Website. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
Article 2. THE PRODUCTS
The products offered for sale by ROSHANARA are those appearing on the Site at the time of its consultation by the Customer.
The products are offered for sale within the limits of available stocks.
The information provided in the description of the items mentions in particular its essential characteristics: colour, description, composition, maintenance, dimensions. If omissions or errors may have occurred in this presentation, ROSHANARA cannot be held liable. The photographs illustrating the products in support of the text do not enter into the contractual field.
Article 3. AVAILABILITY OF PRODUCTS
The products are offered for sale within the limits of available stocks. ROSHANARA undertakes to notify by e-mail the Customer who has placed an order for an unavailable item. In the event of a debit, the Customer will be reimbursed within 48 hours via the PayPal account (Article 7).
Article 4. PRICE AND VAT
The prices indicated on the Site are in euros. They are net, French VAT included (rate on the day of the order). If the VAT rate were to be modified, it would automatically be passed on to the price of the items. ROSHANARA reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the registration of the order.
Not included in the displayed prices:
- Participation in delivery costs, the amount of which is specified before validation of the order and in our GTC article 8.
- Customs charges and other taxes which must be paid by the Customer directly to the carrier.
- Additional costs related to any foreign currency conversion costs.
Any order confirmed by the Customer implies express acceptance of the prices displayed and the descriptions of the products available for sale. The validation of the order and its payment constitutes final confirmation of the order. ROSHANARA will acknowledge receipt of this order by email.
Article 6. PAYMENT
Payment for the order is made by credit card in online payment when the order is validated.
In order to ensure payment security, the Site uses the secure payment services of PayPal, a method simple, fast, secure and free payment. PayPal allows you to pay by credit card in a secure way. The Customer does not transmit his financial details to the seller, who only sees his email address. The Customer only transmits his financial details to PayPal, which protects them using the best anti-fraud technologies on the market.
Financial and personal information is automatically encrypted when sending any sensitive information to PAYPAL servers. For more information on the security of transactions carried out between PAYPAL and the Customer's banking establishment, ROSHANARA invites the Customer to contact PAYPAL.
In the case of returning an item, the refund will be made to the PayPal account used for the payment of the original order
For all online payments by credit card via the PayPal site, the electronic certificate issued by PayPal will serve as proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 and following of the Civil Code. In all cases, the validation of the order is worth signature and express acceptance of all the operations carried out on the Website.
Article 7. DELIVERY
Orders will be delivered to the delivery address indicated by the customer when ordering. The Customer is informed that it is his responsibility to provide all the details necessary for the proper delivery of his order (access code, building, floor, etc.).
In the event of an error in the wording of the contact details, Roshanara cannot be held responsible for the impossibility of delivering the package.
Delivery is deemed to have been made as soon as the order is made available to the Customer by the carrier. The electronic control system used by the carrier will serve as proof of delivery.
Prices and Delivery Times
All orders placed before 12 noon are dispatched the same day.
Orders placed after 12 noon are dispatched the following day.
No orders are shipped on weekends and holidays. An order placed after 12 noon on Friday will be dispatched the following Monday.
Deliveries are handled by Colissimo and UPS. The Customer authorizes us to send them their personal data for the delivery of his order.
A contribution to the shipping costs is invoiced to the Customer and the amount is indicated on the order summary before validation by the Customer.

OTHER COUNTRIES and EXPRESS DELIVERIES
We will put your order on hold and email you a quote for shipping costs which are based on the weight and dimensions of the package
Please note that any customs duties are not included in our prices and are the responsibility of the Customer. Also, some household items cannot be sent overseas as they may be damaged.
Receiving the parcel
Upon delivery of the order, the Customer must carefully check the contents and condition of the package and make any reservations with the carrier in the event of missing items or damage.
Any complaint for non-conformity or missing item on delivery must be sent within 48 hours of receipt of the order.
Any delay in delivery of the order does not give the customer the right to cancel his purchase, refuse the goods or claim damages.
ROSHANARA declines all responsibility in the event of loss, theft, damage or delay in delivery due to errors or disruptions attributable to carriers. In these cases, the Customer must take the appropriate steps directly with the postal services or the carrier.
Article 8. RIGHT OF WITHDRAWAL - RETURN OR EXCHANGE
The return of goods is at the CLIENT's expense. We advise you to return by Colissimo with delivery against signature
Items purchased on sale cannot be returned or exchanged.
In the event that the item(s) ordered are not satisfactory, the Customer has a period of 14 clear days from the date of receipt of the package to return it, in accordance with Article L 121 -20-12 of the Consumer Code, it being specified that when the 14-day period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day. The Customer can request a refund or an exchange.
The customer must contact us by email to request a return form which must be attached to the package of returned items.

The product must be returned in its original packaging, with its product label and in perfect condition. Worn, soiled, damaged, scratched, stained or washed products will not be taken back.
In this case, the package must be returned to the Customer and the return costs are the responsibility of the Customer.
From the exercise of his right of withdrawal, the Customer has a period of 14 days to return the product. In the event of a return accepted by ROSHANARA, the Customer will be reimbursed within a maximum of 14 days from receipt of the returned product and its acceptance, in accordance with the provisions of Article L.121-24-4 of the Consumer Code
If the Customer wishes an exchange, the article or articles desired in exchange will be dispatched within 48rs after payment of the balance to be paid (if the article is more expensive) and the delivery costs.
Article 9. INTELLECTUAL PROPERTY
All elements of the Site are the exclusive property of ROSHANARA.
Article 10. PROTECTION OF PERSONAL DATA
ROSHANARA is committed to protecting the privacy of individuals using The Website.
All orders require prior registration and the creation of a personal account subject to the unconditional acceptance of the Privacy and Cookies Policy by the Customer.
The user undertakes, during the registration procedure, to provide complete and correct information. The creation of the personal account will result in the recording and computer processing of personal data, including IP addresses, which will be communicated to ROSHANARA.
This recording and this processing are intended to allow the order to be taken, and to ensure its delivery to the Customer.
The information collected by ROSHANARA during a Customer's order is necessary for the management of the transaction and for this purpose only, may be communicated in whole or in part to the service providers of ROSHANARA Intervening within the framework of the fulfillment of the order, such as the logistics company or the carrier.
In no case will they be commercially transferred to third parties
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament, the Customer has at any time a right of access, rectification, modification, limitation, deletion by contacting ROSHANARA at the following address: firstname.lastname@example.org
Article 11. APPLICABLE LAW AND JURISDICTION
These T&Cs are subject to French law.
In the event of a dispute, the Customer and ROSHANARA may resort to conventional mediation or alternative dispute resolution methods such as mediation or arbitration. The Customer may contact the dispute resolution platform put online by the European Commission at the following address: http://ec.europa.eu/consumers/odr/.
Any dispute relating to the execution or termination of a sale, the interpretation, execution or termination of these GCS is subject, in the absence of an amicable agreement, to the Court of Versailles
